Terms and Conditions

For the purpose of these Terms and Conditions, Rebecca Jones, trading as RJ Equine Photography, shall hereinafter be referred to as “the Photographer.”


These Terms and Conditions apply to all portrait and commercial Clients, including sessions purchased as a gift or awarded as part of a giveaway.


A non-refundable booking fee of £100 is required to secure the date and time of your photography session. Payment of the booking fee constitutes acceptance of these Terms and Conditions.


The Photographer reserves the right to decline or cancel any photography session where full payment has not been received. The remaining balance must be paid no later than 14 days prior to the scheduled session.

 

Your Photography Session


1. Changes to Schedule or Location

The Photographer must be notified in writing (by email) of any changes to the agreed schedule or location no later than 7 days prior to the Photoshoot. Changes will only be confirmed once the Photographer has acknowledged receipt in writing.


2. Pre-Session Confirmation

The Photographer will contact the Client between 7 and 10 days prior to the Photoshoot to confirm final details. Every reasonable effort will be made to make contact. If the Client cannot be reached, the date, time and location will proceed as originally agreed.


3. Coverage and Limitations

Due to the subjective and time-limited nature of photography, the Photographer cannot guarantee that all requested images will be captured. The Photographer shall not be held responsible for missed images or limited coverage resulting from weather conditions, time constraints, schedule delays, restrictions imposed by venues or locations, or the conduct of individuals present at the session.


4. Shot Requests

Any shot lists provided by the Client are for organisational purposes only. The Photographer will use reasonable efforts to accommodate requests but makes no guarantee that specific images will be delivered.


5. Location Fees and Permits

The Client is responsible for obtaining and paying for any required location fees, permits, or permissions necessary for the Photoshoot.


6. Force Majeure

If the Photographer is unable to perform the session due to circumstances beyond reasonable control, including but not limited to fire, accident, illness, strike, civil disturbance, natural disaster, road closures, severe traffic, or acts of terrorism, the session will be rescheduled to a mutually agreed alternative date.


7. Loss or Damage of Images

In the unlikely event that photographic materials are lost, damaged, or corrupted due to equipment malfunction or other unforeseen circumstances beyond the Photographer’s control, liability shall be limited to rescheduling the session at no additional shoot fee. No further compensation shall be payable.


8. Client Rescheduling

Rescheduling requests must be made in writing at least 7 days prior to the scheduled session. Requests made less than 7 days before the session will incur a £50 rescheduling fee.

The rescheduling fee may be waived in cases of adverse weather, illness, bereavement, or illness/injury to the Client’s horse or dog, at the Photographer’s discretion.

A third rescheduling request without reasonable cause will incur an additional £50 administration fee.


9. Client Cancellation

Cancellations made more than 14 days before the scheduled session will result in the loss of the non-refundable booking fee.

Cancellations made within 14 days of the scheduled session will not be refunded, including booking fees and any payments already made, unless the Photographer agrees otherwise at their discretion (for example, in cases of serious illness or bereavement affecting the Client or their horse/dog).


10. Photographer Cancellation

In the unlikely event that the Photographer must cancel the session, every effort will be made to reschedule to a mutually agreed date.

If rescheduling is not possible, any payments made for the session, excluding the non-refundable booking fee, will be refunded.


Liability, Indemnity and Assumption of Risk


1. The Client acknowledges that riding, handling, working with, or being in close proximity to horses and dogs is inherently dangerous and carries a risk of serious injury, death, loss, or damage due to the unpredictable nature and behaviour of animals, regardless of their training or past performance.


2. The Client voluntarily assumes full responsibility for any risk of injury, loss, or damage arising from participation in the photography session.


3. The Client agrees to indemnify and hold harmless the Photographer against any claims, demands, losses, liabilities, damages, costs, or expenses (including legal costs) arising out of or in connection with:

(a) the actions or behaviour of the Client, their animal(s), or any person under their control;

(b) any injury to persons or animals, or damage to property caused during the session; or

(c) any failure to disclose relevant behavioural or health issues.


4. The Client must disclose in writing, prior to the photography session, any known behavioural issues, health concerns, or safety risks relating to any equine or canine involved.


Copyright and Image Use


1. All images created by the Photographer remain the intellectual property and copyright of the Photographer at all times. Ownership of any products or digital files transfers to the Client only once full payment has been received.


2. The Photographer retains full copyright in all images produced and reserves the right to use images for portfolio purposes, including but not limited to professional samples, website display, social media, advertising, exhibitions, competitions, and promotional materials. Clients who do not wish for their images to be used for marketing purposes must notify the Photographer in writing prior to the session.


3. Where high-resolution digital images are purchased, the Client will be granted a non-exclusive, non-transferable licence for personal use only. Images must not be used for commercial purposes, profit, advertising, publication, competition entry by third parties, or supplied to brands, sponsors, or media outlets without prior written consent from the Photographer.


4. Images must not be altered in any way, including but not limited to cropping, applying filters, changing colours, or removing watermarks. If alternative edits are required, the Client must contact the Photographer directly to request authorised amendments.


5. Watermarked, low-resolution images shared by the Photographer may be reposted on social media provided they remain unaltered and full credit is given to RJ Equine Photography. Removal or alteration of the watermark constitutes a breach of copyright.


6. All images are edited at the Photographer’s professional and artistic discretion. The Photographer is not obliged to supply every image taken and reserves the right to deliver only those images deemed to meet professional and artistic standards.


Your gallery viewing


1. Final images will be presented at a private, in-person viewing session. Where necessary, this may take place via Zoom. Online proofing galleries are not provided. Clients should allow up to 2 hours for the viewing appointment.


2. All product orders will be confirmed in writing at the viewing session. The Client is responsible for checking and approving all order details at the time of purchase. Once the order form has been completed and confirmed, changes cannot be made.


3. Where a full gallery of high-resolution digital files is purchased, these will be supplied on a USB device. Individual digital images will be delivered electronically.


4. Frame orders are typically completed within 4 weeks of the order date. Album orders are typically completed within 6 weeks. Production times may be extended during bank holidays or peak periods.


5. Framed products may be collected directly from the Photographer or delivered to a home address. Home delivery is subject to a £20 delivery fee.


6. Full payment for all products is required at the viewing session. No products or digital files will be delivered until payment has been received in full. Payment may be made by cash, credit/debit card, or bank transfer.


7. If the Client is dissatisfied with any product, they must notify the Photographer in writing at info@rjequinephotography.co.uk

within 7 days of receipt so that the matter can be reviewed and resolved.


8. Where digital files are purchased for self-printing, the Photographer accepts no responsibility for print quality, colour accuracy, or finish produced by third-party laboratories.
